Terms of Service

These Terms of Service (“Terms”) govern your use of LuckySMP (“Service”), operated by Keller Online Services from Switzerland. By connecting to our Minecraft servers, joining our Discord or purchasing any digital item from our shop, you accept these Terms in full. If you do not agree, please do not use the Service.

1. Scope of the Service

We operate Minecraft: Java Edition game servers, a Discord community, a public website and a web shop. The shop offers digital goods only, including but not limited to ranks, shards, keys, cosmetics and recurring subscriptions. All items are consumed exclusively on the LuckySMP network. Payment is processed by PayNow.gg, which acts as merchant of record.

The shop complies with the Minecraft Commercial Usage Guidelines. We do not sell gameplay advantages that break the core balance of survival play. We do not operate loot boxes or randomised reward mechanics that constitute gambling under applicable law.

Feature changes: The features and benefits associated with any purchased item reflect what is available at the time of purchase. We may modify, rebalance or remove features at any time to maintain server balance, comply with Mojang's guidelines or for operational reasons. The word “permanent” where used in item descriptions refers to the duration of server access, not a guarantee that specific features will remain unchanged. Modifications to features do not entitle you to a refund unless mandatory law requires otherwise.

2. Contract Formation

A binding contract between you and us is formed when PayNow.gg confirms your payment and we deliver the purchased digital item to your Minecraft account. You must provide a correct Minecraft username at checkout; we are not responsible for items delivered to an incorrect username entered by you. Purchases made by parents or guardians for accounts managed by minors are subject to the same Terms and the purchasing party assumes full responsibility for all activity on the benefiting account.

3. Payment and PayNow Buyer Agreement

Prices are displayed in the currency shown at checkout and include any applicable taxes where stated. Payment is processed exclusively via PayNow.gg. By completing a purchase you additionally accept the PayNow Buyer Agreement and PayNow Terms of Use. Disputes about the payment itself are handled by PayNow in accordance with their terms.

4. Digital Delivery and No Right of Withdrawal (Swiss Customers)

All items sold through the shop are digital goods delivered immediately and automatically to your Minecraft account after payment has been confirmed.

Swiss contract law (Swiss Code of Obligations) does not provide a general statutory right of withdrawal for online or distance purchases. Accordingly, once a digital item has been delivered, the purchase is final and not refundable unless otherwise stated in these Terms or granted by us voluntarily in individual cases.

5. Right of Withdrawal for Customers in the European Economic Area

If you are a consumer residing in the European Economic Area (EEA) or the United Kingdom, you generally have a statutory right of withdrawal of 14 days for distance contracts. However, in accordance with Art. 16 lit. m of Directive 2011/83/EU (and the equivalent national implementations, e.g. § 356(5) BGB in Germany), this right does not apply to contracts for the supply of digital content that is not supplied on a tangible medium, if:

  • performance has begun before the end of the 14-day period, and
  • the consumer has expressly consented to this and acknowledged that the right of withdrawal is thereby lost.

At checkout, you are required to actively confirm these conditions via a dedicated checkbox before the purchase is completed. By ticking that checkbox, you expressly request immediate execution and acknowledge the loss of your right of withdrawal. A general acceptance of these Terms is not sufficient to constitute this waiver; the checkout confirmation is required.

If we failed to provide you with the required pre-contractual information about the right of withdrawal before purchase, your withdrawal period may be extended by up to 12 months from the end of the original 14-day period pursuant to Art. 10 of Directive 2011/83/EU. In such cases, please contact us at info@luckysmp.net.

For disputes arising from purchases covered by EU consumer law, you may also use the EU Online Dispute Resolution platform (see § 21).

6. Subscriptions

Some products are offered as recurring subscriptions. Subscriptions renew automatically at the end of each billing cycle unless cancelled in advance. You can cancel a subscription at any time via PayNow's subscription portal: https://checkout.paynow.gg/subscriptions?tab=0.

Cancellation stops future renewals. You retain access to the purchased benefits until the end of the current billing cycle. No prorated or partial refunds are issued for unused time.

7. Refund Policy

All items sold are digital goods delivered immediately after purchase. Refunds are generally excluded. In particular, no refunds are granted for:

  • Incorrect purchases (e.g. wrong Minecraft username entered)
  • Change of mind
  • Inactivity or loss of access to your Minecraft account
  • Temporary technical issues on our side or on Mojang's side
  • Changes to the server software, plugins, gameplay or economy
  • Loss or modification of digital content following server or game updates
  • Seasonal resets: LuckySMP operates on a seasonal model. At the end of a season, progress and season-specific items may be reset by design. This is disclosed in advance and does not entitle you to a refund, replacement or compensation.
  • Bans or other sanctions for rule violations (see § 9)

Exceptions are limited to the following cases and handled individually at our discretion:

  • Duplicate charge caused by a technical error on our side or on PayNow's side, evidenced by order confirmations
  • A purchased item could not be delivered due to a persistent technical fault on our side that we cannot resolve within a reasonable period
  • Where mandatory consumer protection law requires a refund

EU consumer rights: If you are an EU consumer and believe you are entitled to a statutory refund or withdrawal, please contact us at info@luckysmp.net before initiating a payment dispute. Exercising a valid statutory right through this process will not result in a ban. Initiating a chargeback or payment dispute with your bank or card provider without first contacting us and giving us a reasonable opportunity to resolve the matter is considered a fraudulent chargeback and will result in the permanent ban of all associated accounts and the forfeiture of all purchased digital goods on those accounts. We reserve the right to contest fraudulent chargebacks and provide all relevant evidence to PayNow and the relevant payment processor.

8. Mojang Commercial Usage Guidelines

Items sold in our shop comply with Mojang's Commercial Usage Guidelines: we do not sell items that grant gameplay advantages that break the core balance of survival play, and we do not operate randomised loot mechanics. We reserve the right to rebalance, remove or replace items at any time to remain compliant. Where an item is removed for compliance reasons, active subscribers retain access to comparable or replacement benefits for the remaining billing period where reasonably possible.

All rights to the Minecraft brand, software and associated intellectual property remain with Mojang Synergies AB and Microsoft Corporation. Mojang reserves the right to revoke commercial permissions at any time. In such an event, we are not liable for any resulting interruption of service or loss of access to purchased features.

9. User Conduct, Rules and Sanctions

By using the Service, you agree to comply with our published server rules and applicable law at all times. The following conduct is prohibited and may result in warnings, temporary or permanent mutes, kicks or bans, at our sole discretion:

  • Harassment, hate speech, discrimination, racism or targeted abuse of any player or staff member
  • Spamming, flooding or unsolicited advertising in any chat channel
  • Sharing, soliciting or distributing NSFW, self-harm or illegal content
  • Impersonating other players, staff members or our network
  • Lying to or deliberately misleading staff members during an investigation
  • Using hacked, modified or cheat clients (see § 12)
  • Exploiting bugs or duplicating items (see § 13)
  • Using, sharing or distributing the server world seed obtained through any means, including packet interception, third-party tools or exploitation of bugs. World seeds are confidential business information of the operator.
  • Threatening, initiating or facilitating any denial-of-service (DDoS), doxing (DoX) or swatting attack against our infrastructure, our staff or any other player. Such threats constitute a criminal offence in most jurisdictions. We preserve all evidence - including IP addresses, timestamps and chat logs - and will report credible threats to law enforcement without further notice.
  • Real-world trading of in-game items or currency (see § 15)
  • Any other conduct that we reasonably determine to be harmful to the Service, our community or third parties, even if not explicitly listed here. We exercise house rules and reserve the right to issue sanctions for any behaviour that violates the spirit of these rules.

Purchased items, ranks and subscription time are not refunded when an account is sanctioned for rule violations. Staff may request evidence (e.g. screenshots, recordings) before issuing or reversing a sanction. Sanction decisions may be appealed via a ticket in our Discord server; appeals are reviewed at our discretion and are not guaranteed.

10. Account Security

You are solely responsible for keeping your Minecraft, email, Discord and PayNow accounts secure. We do not recover items delivered to an account you lost control of, and we do not hand over account-related data to third parties without verification. Staff members will never ask for your password, authentication codes or payment details. Any such request is fraudulent and should be reported immediately.

11. Account Sharing and Alt Accounts

You are responsible for all actions taken on your Minecraft account while connected to our network, regardless of whether you personally performed them. Sharing your account with another person does not transfer, reduce or excuse any responsibility for rule violations committed on that account. Purchased items and ranks are non-transferable between accounts.

Each player may operate a maximum of five (5) Minecraft accounts on our network. Accounts beyond this limit or accounts used to circumvent restrictions may be sanctioned without warning.

Creating or using alternative Minecraft accounts to evade an active ban, mute or other sanction is strictly prohibited and will result in the immediate permanent ban of all associated accounts. All purchased items, ranks or currency on accounts used for sanction evasion are forfeited without refund. We reserve the right to apply sanctions to accounts we reasonably identify as belonging to the same individual based on IP address, device fingerprint or behavioural patterns, without disclosing the specific detection method.

12. Allowed Client Modifications

You may connect to our network using the official Minecraft: Java Edition client or approved third-party clients and modifications. The following are generally permitted:

  • Performance and rendering mods (e.g. Sodium, OptiFine, Iris, Lithium)
  • Minimap mods that display terrain and player waypoints only, with no entity radar, cave finder or underground rendering
  • HUD mods that display information already available in vanilla (coordinates, FPS, armour durability)
  • Schematic and building-assistance mods on creative or building servers only
  • Accessibility mods (e.g. colorblind filters, zoom, larger text)

The following are strictly prohibited and will result in a permanent ban without refund:

  • Hacked clients or any client that provides an unfair advantage, including but not limited to: kill-aura, aimbot, reach hacks, speed hacks, fly hacks, bhop, anti-knockback, no-fall, fast-break
  • X-ray texture packs or mods, cave finders, entity trackers or any modification revealing content not visible in vanilla
  • Auto-clickers, macros or scripts that automate combat, gathering, farming, crafting, trading or any other gameplay action
  • Inventory management mods that perform automatic sorting, restocking or item-move actions without manual input per action
  • Freecam, spectator-bypass mods or modifications that allow you to see or interact with areas outside your normal view or reach
  • Radar or health indicator mods that display other players' health, inventory content or location through walls
  • Modifications that communicate with external servers or services for the purpose of gaining gameplay information
  • Exploiting bugs or using duplication glitches (see § 13)

If you are unsure whether a specific modification is permitted, ask a staff member on Discord before using it. Ignorance of the rules is not a valid defence against a sanction. You are responsible for all software running on your device when connected to our network; claiming a third party used your account or installed a modification without your knowledge is not a defence.

13. Bug Reporting and Exploitation

If you discover a bug, exploit or unintended game mechanic, you are required to report it to our staff via Discord or in-game as soon as reasonably possible. You must not exploit, share or profit from a bug before reporting it.

Exploiting a known or unknown bug for personal gain - including item or currency duplication - is a serious violation and will result in a permanent ban and the removal of all items or currency obtained through the exploit, regardless of how long the exploit was active. We may additionally roll back the accounts of other players affected by a duplication exploit. No refund is issued for purchased content on accounts permanently banned for bug exploitation.

14. Content Creation and Streaming

You are permitted to record, stream and publish footage of your gameplay on the LuckySMP network on platforms such as YouTube, Twitch and TikTok. By doing so you grant us a non-exclusive, royalty-free, worldwide licence to share and embed your publicly available content for promotional purposes (for example on our Discord or social media). We will credit you where reasonably practical. You may revoke this licence at any time by contacting us; revocation does not affect any use made prior to the request.

You must not publish footage that reveals private player data such as coordinates of hidden bases, the server world seed, private conversations, or personal information of other players without their explicit consent. Content that violates our server rules, these Terms or applicable law (including hate speech, harassment, incitement or privacy violations) must not be published and may result in sanctions under § 9.

15. Prohibition of Real-World Trading

All virtual items, ranks, in-game currency and content available through our network have no monetary value outside the game and cannot be sold, traded or exchanged for real-world currency or goods between players through any channel other than our official store. Specifically prohibited are:

  • Selling in-game items, currency, accounts or services for real money between players (“IRL trading”)
  • Cross-server trading: trading items or currency obtained onLuckySMP for items or benefits on other Minecraft servers, and vice versa
  • Offering or accepting payment outside our official store in exchange for in-game assistance, services or items

We are not responsible for any losses resulting from unauthorised player-to-player real-money transactions. We will not mediate, arbitrate or reimburse any party in such disputes. Engaging in IRL trading may constitute unauthorised commercial activity and may be reported to relevant authorities where applicable. Violations result in a permanent ban without refund.

16. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, software updates, infrastructure failures or force majeure events may cause temporary downtime. Short interruptions do not entitle you to a refund, a credit or the termination of a subscription. We publish planned maintenance notices on our Discord where reasonably possible.

17. Limitation of Liability

To the extent permitted by Swiss law, our liability is limited to damages caused by intent or gross negligence. We are not liable for indirect or consequential damages such as loss of profit, loss of in-game progress, loss of data, or damages caused by third-party services including Mojang, Microsoft, Discord or PayNow. Liability for death, personal injury or mandatory Swiss product liability law remains unaffected.

We are not liable for any loss or damage arising from your failure to comply with these Terms, including the loss of account access, purchased items or in-game progress resulting from a ban.

18. Intellectual Property

The name “LuckySMP”, our logo, textures, custom plugins, maps, artwork and written content are protected by copyright and may not be copied, redistributed or monetised without our prior written consent. Minecraft and associated marks are trademarks of Mojang Synergies AB. We are not affiliated with, endorsed by or sponsored by Mojang AB or Microsoft Corporation.

19. Changes to These Terms

We may update these Terms to reflect changes in the Service, in applicable law, or in our business practices. The current version is always published at this URL with a “Last updated” date. Material changes will be announced on our Discord at least 7 days before taking effect where practicable. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms.

20. Governing Law and Jurisdiction

These Terms are governed by the substantive law of Switzerland, excluding conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection provisions of the country in which a consumer has their habitual residence remain unaffected and take precedence where they grant greater protection than Swiss law.

For B2B disputes the exclusive place of jurisdiction is Menzingen, Canton of Zug, Switzerland. Consumers may additionally bring claims before the courts competent for their place of residence under the Swiss Code of Civil Procedure or equivalent international provisions.

21. Consumer Dispute Resolution (EU ODR)

The European Commission provides an Online Dispute Resolution (ODR) platform for out-of-court settlement of disputes arising from online purchases. EU consumers may submit a complaint via:

https://ec.europa.eu/consumers/odr

Our email address for ODR purposes is info@luckysmp.net. We are not obligated to participate in an alternative dispute resolution procedure before a consumer arbitration board, but we will consider participation on a case-by-case basis.

22. Contact

Questions about these Terms can be sent to info@luckysmp.net or posted in our Discord. For general support questions please use Discord; the email address is for legal inquiries only.
